Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Kapish AI, operated by SaasPoint Technologies Pvt. Ltd. ("Company", "we", "us"). By accessing or using our service, you agree to these Terms.

2. Description of Service

Kapish AI is a cloud-based hotel property management system (HMS) that includes: room management, booking and billing, night audit, staff management, inventory tracking, AI-powered business intelligence, and marketing tools including an AI Poster Studio.

3. Account Registration

• You must provide accurate information during registration
• You are responsible for maintaining the security of your account
• One account may manage multiple hotel businesses
• You must be 18 years or older to create an account
• You must be authorized to act on behalf of the hotel business

4. Free Trial

New hotel accounts receive a 30-day free trial with full access to all features. No credit card is required during the trial period. At the end of the trial, you must subscribe to a paid plan to continue using the service. Your data is retained for 90 days after trial expiry.

5. Subscription and Payment

5.1 Plans

We offer three annual subscription plans: Starter (up to 10 rooms, ₹8,388/year), Growth (up to 20 rooms, ₹11,988/year), and Pro (unlimited rooms, ₹19,188/year). Prices are inclusive of applicable taxes.

5.2 Billing

All subscriptions are billed annually in advance. Payments are processed securely by Cashfree Payments India Pvt. Ltd.

5.3 Refunds

We offer a 7-day refund window from the date of first payment. After 7 days, subscriptions are non-refundable. Refund requests: support@kapishai.com

5.4 Price Changes

We will give 30 days notice before changing subscription prices. Existing subscribers will be notified by email.

6. Acceptable Use

You agree not to:

• Use the service for any illegal purpose or in violation of Indian law
• Enter false guest information or fraudulent booking records
• Attempt to reverse engineer or copy the software
• Share your account credentials with unauthorized parties
• Use the AI Brain to generate illegal, harmful, or misleading content
• Resell or sublicense access to the platform

7. Your Data

You own all data you enter into Kapish AI. We do not claim ownership of your hotel's business data, guest records, or financial information. You grant us a limited license to process this data to provide the service.

8. AI Services

The AI Brain feature uses Claude AI by Anthropic. AI-generated responses are for informational purposes only and should not be relied upon as professional financial, legal, or medical advice. The AI may occasionally produce inaccurate information.

9. Service Availability

We target 99.5% uptime. Scheduled maintenance will be announced 24 hours in advance. We are not liable for losses resulting from service unavailability beyond our reasonable control.

10. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate accounts that violate these Terms. Upon termination, you may export your data within 90 days.

11. Limitation of Liability

To the maximum extent permitted by Indian law, SaasPoint Technologies shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in West Bengal, India.
